SCARPAR RESERVATION TERMS AND CONDITIONS

General Terms and Conditions

By making a reservation deposit, the depositor (herewith 'you' OR 'your') agrees to ALL of the terms and conditions below, which creates a legally binding agreement with respect to your reservation:

You must be at least 18 years of age to reserve a vehicle. This is a compliance requirement, and by proceeding with a reservation deposit you are hereby representing that you are at least 18 years of age.

When SCARPAR Pty Ltd (“SCARPAR”) receives your reservation deposit, you will be placed in sequence on the reservations list for the specific vehicle model. The reservation list details and sequence will not be disclosed.

Final pricing, specifications, styling options and delivery schedule guidance will be provided as soon as they are available and are no longer likely to change. The final pricing and schedule will not be known any earlier than late 2011. Apart from any processing fees charged to SCARPAR by PayPal or other financial institutions (the “Processing Fees”), your deposit, net of the Processing Fees, is fully refundable should you choose to cancel your reservation at any time prior to making full payment for your purchase(s).

All transactions are in US dollars. SCARPAR will only transact purchases in US dollars and any refunds will be in US dollars. SCARPAR assumes no responsibility and will not cover any losses resulting from currency value changes with respect to your deposit(s).

SCARPAR will notify you of the process for selecting your vehicle color scheme and will give you the opportunity to include accessories in your order when this information is available. 

You will be required to attend a SCARPAR dealership in order to undertake the delivery process prior to taking possession of your vehicle. The nearest dealer to you will be revealed once your vehicle is available for delivery. You may have a choice regarding which dealer you acceptdelivery from if there are multiple dealers within your region, or you may travel outside your region if that is your preference.

Once delivery dates are confirmed, you will be required to pay for your vehicle and any accessories in full prior to arranging your delivery with SCARPAR. 

Once you have paid for your vehicle and any accessories ordered, you may cancel your reservation and obtain a refund of all reservation fees less a $1,000 cancellation charge, subject to applicable local law. However, if SCARPAR cancels your reservation, which SCARPAR has the authority to do in its absolute discretion, you will receive a complete refund of all monies paid less the Processing Fees.

SCARPAR may, at its absolute discretion, decide not to produce your particular vehicle model. If this happens, you may, at your sole discretion, change your order to another vehicle model if available, or you elect to receive a full refund of all fees paid less the Processing Fees.

You agree to notify SCARPAR if your email address or phone number changes. If SCARPAR attempts to contact you and you do not respond after SCARPAR has made reasonable effort, your order may be cancelled at the sole discretion of SCARPAR and you will be issued a refund less the Processing Fees.

Limitation of Liability

Under no circumstances will SCARPAR be held liable for incidental, special, or consequential damages arising out of your reservation, even if SCARPAR or a SCARPAR representative has been advised of the possibility of such damages. In the event SCARPAR is held liable for any damages related to such matters, your sole and exclusive remedy will be limited to reimbursement of reservation fees paid to SCARPAR less the Processing Fees. In the event of any dispute with respect to these Reservation Terms and Conditions, you hereby agree and submit yourself to the exclusive jurisdiction and venue of Queensland, Australia and the courts situated in Queensland, Australia and agree that you shall not object to such jurisdiction or venue on the grounds of lack of personal jurisdiction, forum non conveniens or otherwise.

Use of Funds

Reservation fees will be held by SCARPAR Pty Ltd and will not be used for operating costs. No interest is payable on reservation deposits or full payments. Once your full payment is received, funds will then be available to SCARPAR for funding of inventory and operational costs to support the delivery of vehicles to customers.

General Risk Statement

You acknowledge that your reservation fee may be lost, in part or in whole, if SCARPAR ceases to be viable as a company and loses control of financial management of the company. If SCARPAR remains viable, but production is cancelled, you will receive a full refund less any the Processing Fees.

Dealers

If you are interested in becoming a dealer we recommend you reserve two (2) of each vehicle models you intend to sell. One of each model will be for display purposes, and one of each vehicle model will be for demonstration purposes. Reservation does not guarantee dealership, however it does demonstrate an initial commitment to aid in decision making. When the dealer program is finalized, discounts will be applied prior to final payment. If you intend to be a dealer please indicate this during the final payment process by selecting the correct buyer type. As with other reservations, you will have the option to request a refund less the Processing Fees should you be unsuccessful in your application. Please note; retail store front, delivery / customer induction capability and servicing capability will be required to become a dealer. Online only stores will not be considered as a physical delivery / induction process and servicing is required of all dealers.
